BOE to Seek Review of ITC’s Initial Ruling in Trade Secret Case, Vows Strong Countermeasures

AsianFin -- Following the initial ruling by a U.S. International Trade Commission (ITC) administrative law judge in a Section 337 investigation into OLED trade secrets, China’s BOE Technology Group plans to request a review of the decision.

The preliminary ruling found BOE infringed on Samsung Display’s trade secrets and recommended an import ban. In response, BOE is also filing patent lawsuits against Samsung Display in the U.S. to push back against what it calls ongoing suppression efforts by Samsung.

Over the past two years, the dispute has escalated, with BOE initiating multiple patent infringement cases against Samsung in both U.S. and Chinese courts. Notably, a Chinese court in Chongqing issued a first-instance verdict in November 2024, ruling that Samsung Display’s OLED panels infringed BOE’s patents.
