OpenAI Urges Court to Keep Countersuit Against Elon Musk, Calling Dismissal Bid Baseless

AsianFin -- OpenAI is pushing back against Elon Musk’s attempt to dismiss its countersuit, arguing the Tesla CEO’s motion has “no grounding in facts,” according to a court filing late Wednesday.

The ChatGPT maker urged the court to include its countersuit—accusing Musk of fraudulent business practices under California law—in an expedited trial rather than delay it.

OpenAI claims that a $97.4 billion acquisition offer from a Musk-led consortium earlier this year was a “sham bid” designed to generate media buzz. The company alleges the proposal was leaked to the press before being formally submitted to OpenAI’s board.

Musk, who co-founded OpenAI in 2015 but exited before it became a major force in artificial intelligence, filed a lawsuit last year against the company and CEO Sam Altman. He accused them of abandoning OpenAI’s original mission to develop AI for the benefit of humanity—not for corporate gain.
